The project restricts occupancy to elderly families and families in which the head of household or spouse has a physical disability pursuant to the requirements of Section 3-18.B of HUD Handbook 4350.3. • The project qualifies to restrict occupancy to this population because it was originally financed with a Section 202 loan in 1965 and was designed for occupancy by elderly families, as evidenced by the project’s 202 Loan Agreement and 202 Regulatory Agreement. These documents serve as primary sources showing that the property was originally designed for occupancy primarily by elderly families, as required under Section 3-18.B.3 of HUD Handbook 4350.3. • 10% of units were designed for handicapped persons with mobility impairments. Those units are restricted to families (elderly or nonelderly) who require the accessibility features of the unit. o A person is considered handicapped under this section if such person is determined to have a physical impairment which is (1) expected to be of long-continued and indefinite duration, (b) substantially impedes his/her ability to live independently, and (c) is of such a nature that such ability could be improved by more suitable housing conditions. o To qualify for one of these units, the head of household or spouse must be at least 18 years old and have a disability requiring the accessible features of the unit. • The remaining 90% of units are restricted to elderly families. An elderly family is one in which the head of the household, cohead, or spouse is at least 62 years of age.
